This proposed constitutional amendment, if approved by the voters, provides that a person’s electronic communication and data are protected from unreasonable searches and seizures performed by the government. The amendment specifies that prior to issuance, a warrant must describe the data or communication to be accessed and be supported by probable cause.

Ballot Title: “Shall the Missouri Constitution be amended so that people shall be secure in their electronic communications and data from unreasonable searches and seizures as they are now likewise secure in their persons, homes, papers and effects?”

This question was referred to the ballot by the state legislature during the 2014 legislative session. (Link to Senate Joint Resolution 27)
